Trade Marks
Companies often find
themselves gaining
competitive advantage or
consumer recognition
through things like
logos and catch
phrases. These types of
distinguishing features
are covered under Trade
Mark protection.
Section 2 of the Trade
Marks Act defines a
Trade Mark as, "A mark
that is used by a person
for the purpose of
distinguishing.......wares
or services
manufactured, sold,
leased, hired or
performed by
him.........from those
manufactured, sold,
leased, hired or
performed by others"
This could include a
certification mark, a
distinguishing guise,
logo, name, phrase,
color scheme/icon and
sometimes a package
design.
